1. Agreement to Terms
By accessing or using Pingroot ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.
The Service is operated by Pingroot LLC, a Wyoming limited liability company.
2. Description of Service
Pingroot is an API monitoring platform providing:
- HTTP/HTTPS endpoint monitoring via a global network (including Cloudflare Workers).
- Uptime, latency, and status code tracking.
- Advanced security features such as Customer-Managed Keys (AWS KMS) for eligible plans.
3. Account Security & Registration
3.1 Account Creation
You may register via email/password or third-party OAuth providers (Google, GitHub). You are responsible for maintaining the confidentiality of your credentials.
3.2 Eligibility
You must be at least 18 years old. Using the Service on behalf of an organization implies you have the authority to bind that entity to these Terms.
4. Subscriptions, Fees, and Payments
4.1 Subscription Tiers
The Service is offered in various tiers (Free, Pro, Team, etc.). The specific features, limits, and pricing for each tier are detailed on our official Pricing Page and are incorporated into these Terms by reference.
4.2 Payments & Billing
All paid subscriptions are billed in advance on a recurring basis (monthly or annually) via Stripe. By subscribing, you authorize us to charge your provided payment method for the applicable fees.
4.3 Changes to Fees
We reserve the right to modify our pricing at any time. Any price changes will apply to the next billing cycle following a 30-day notice provided via email or an in-app notification.
4.4 Refunds
Except as required by law, all fees are non-refundable. If you cancel your subscription, you will retain access to the paid features until the end of your current billing period.
5. Acceptable Use Policy
You strictly agree NOT to:
- Monitor endpoints you do not own or have explicit authorization to test.
- Use Pingroot to coordinate or execute Denial of Service (DoS/DDoS) attacks.
- Attempt SSRF (Server-Side Request Forgery) by monitoring private or internal networks.
- Circumvent rate limits or infrastructure protections.
Violation of this policy will lead to immediate account termination without refund.
6. Intellectual Property
6.1 Our Property
The Pingroot brand, software, and underlying infrastructure (including our monitoring logic) remain the exclusive property of Pingroot LLC.
6.2 Your Data
You retain ownership of your configuration data (URLs, Headers). You grant us a limited license to process this data solely to perform the monitoring services. API Keys and sensitive headers are encrypted at rest (AES-256).
7. Disclaimers & Limitation of Liability
7.1 "As Is" Basis
THE SERVICE IS PROVIDED "AS IS". WE DO NOT GUARANTEE 100% UPTIME OR ABSOLUTE ACCURACY OF MONITORING DATA. DATA DELIVERY (ALERTS) DEPENDS ON THIRD-PARTY NETWORKS.
7.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY THE LAWS OF WYOMING, PINGROOT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, OR SPECIAL DAMAGES. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.
8. Governing Law & Jurisdiction
8.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict of law provisions.
8.2 Dispute Resolution
Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Cheyenne, Wyoming. You waive any right to a jury trial or class action participation.
9. Termination
We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or our infrastructure.
